Vincent is a Dispute Resolution Partner at EGP, boasting a wealth of experience spanning multiple legal domains.
His practice encompasses intellectual property advisory & litigation, conveyancing, corporate advisory, medico-legal matters, and, notably, a comprehensive array of general civil litigation areas such as commercial disputes, directors and shareholders disputes, construction disputes, arbitration, CIPAA (Construction Industry Payment & Adjudication Act), debt recovery, defamation, winding up and insolvency proceedings, corporate restructuring and corporate rescue mechanisms, divorce and matrimonial disputes, child custody matters, as well as contentious probate cases.
Vincent embarked on his legal career during his pupillage, focusing on intellectual property law, where he assisted clients in securing intellectual property registrations both locally and internationally, and provided intellectual property advisory services.
However, as his career progressed beyond pupillage, Vincent expanded his legal horizons and gained experience in various fields, including conveyancing, corporate & commercial advisory, contract drafting, medical negligence, and ultimately, general civil litigation.
Some of Vincent’s achievements throughout his practice are as follows:
Advised on and drafted the constitution for an International Business School providing tertiary education in Malaysia.
Negotiated, advised, and drafted the Build Own & Operate Agreement for a Palm Oil Company concerning the construction of a biogas power plant in Malaysia.
Negotiated, advised, and drafted a 30-year Lease Agreement on behalf of a local logistic company with a Malaysian local authority. The purpose was to redevelop the area into a regional e-commerce distribution hub, alongside establishing complementary service facilities such as clinics, hotels, and convenience stores to support the e-commerce distribution hub in Malaysia.
Advised and drafted the Service Agreement, Non-Disclosure Agreement, Terms of Use, and Privacy Policy for a local fintech company, facilitating the development of a new mobile payment application.
Negotiated and drafted a Joint Venture Agreement between two local insurance companies, paving the way for the development of a new insurance website and portal, underwriting and launching of a new marine cargo and container insurance product in Malaysia.
Successfully defended a local developer and its shareholder-director in the Malaysian Court of Appeal against an RM4.6 million claim initiated by 77 purchasers. The claim was rooted in allegations of fraud and entailed complex issues such as separate legal entity and piercing the corporate veil.
Successfully defended a shareholder-director of a local food and beverage company in a High Court of Malaya case against an RM1.7 million claim brought by a fellow shareholder, centered on allegations of fraud and breach of fiduciary duty.
Successfully defended a shareholder-director of a local education company in a derivative action initiated by the company in the High Court of Malaya. The case revolved around allegations of breach of fiduciary duty by the shareholder-director.
Successfully defended a construction company in a construction dispute initiated by its subcontractor. Additionally, the construction company effectively counterclaimed a total of RM800k from the subcontractor, encompassing the losses and damages incurred due to the subcontractor's breach of contract.
Represented an international business association and its founding President as Plaintiffs in a defamation suit. This included successfully opposing an application for security for costs filed by the Defendants, who sought RM300k to be set aside pending the disposal of the defamation suit. The application was based on the grounds that the Plaintiffs were foreign nationals and do not have any assets in Malaysia.
Secured a claim of exceeding the sum of RM400k on behalf of a local construction company through adjudication under the Construction Industry Payment & Adjudication Act 2012, showcasing expertise in construction law.
Successfully obtained damages for a patient in a medical negligence lawsuit against a hospital and a doctor. The case centred on the failure to diagnose an ectopic pregnancy, resulting in the patient losing one of her fallopian tubes.
