This article is part of our guide to MM2H property rules in Malaysia. Every MM2H participant must satisfy both the Federal MM2H property requirement (Silver RM600,000, Gold RM1,000,000 and Platinum RM2,000,000) and the State’s foreign property acquisition policy, whichever is higher. In Kuala Lumpur and Selangor, the MM2H visa does not lower the minimum price a foreign purchaser must pay.

State Rules – Kuala Lumpur

As a general rule, foreign purchasers may only acquire real property in Kuala Lumpur with a purchase consideration of not less than RM1,000,000 per property. In addition, every acquisition by a foreign individual or foreign-controlled entity is generally subject to the approval of the relevant State Authority under s.433B of the NLC before the transfer of ownership can be registered.

Notwithstanding the applicable monetary threshold, certain categories of property remain unavailable to foreign purchasers. These generally include:

  • Malay Reserved Land;
  • Bumiputera-designated units; and
  • Low-cost or low-medium cost residential properties.

Now, let’s compare the MM2H requirements with the minimum threshold for foreign purchasers in Kuala Lumpur. For example, while a Silver MM2H participant is required under the Federal MM2H framework to purchase a residential property with a minimum value of RM600,000, the applicable foreign ownership threshold in Kuala Lumpur remains RM1,000,000. As the higher minimum must be satisfied, a Silver MM2H participant intending to purchase residential property in Kuala Lumpur would generally need to acquire a property with a purchase price of not less than RM1,000,000.

A summary of the minimum requirements for foreign purchasers with MM2H and without is as follows:

Without MM2HSilverGoldPlatinum
Federal MM2H requirement–RM600,000RM1,000,000RM2,000,000
Kuala Lumpur State minimumRM1,000,000RM1,000,000RM1,000,000RM1,000,000
Effective minimumRM1,000,000RM1,000,000RM1,000,000RM2,000,000

In short, an MM2H holder cannot benefit from the MM2H visa when it comes to purchasing a residential property in KL. In fact, while a non-MM2H foreign purchaser may purchase an eligible residential property from RM1,000,000 onwards, a Platinum MM2H participant must still satisfy the higher minimum purchase requirement of RM2,000,000.

State Rules – Selangor

Selangor has more restrictive policies, as the minimum depends on both the property category and zoning.

General rules in Selangor for non-MM2H holders:

ZoningResidential (Strata Titles only – be it high-rise / landed)CommercialIndustrial

Zone 2 – Kuala Selangor, Kuala LangatRM2,000,000

Regardless of the zone, foreign purchasers are generally not permitted to acquire:

  • Malay Reserved Land;
  • Bumiputera-designated units;
  • Low-cost and low-medium cost residential properties; and
  • Properties acquired through auction.
